It turns out the music rights weren’t finalized when Adam Yauch screened the basketball documentary at the Tribeca Film Festival in April. http://womanonfilm.blogspot.com/2008/04/tribeca-dispatch-monday-april-28.html
My favorite musical sequence, “Hypnotize,” disappeared from the final cut! I asked Yauch at the Q&A on the 27th; apparently, the estate that holds the rights to the sample in the Notorious B.I.G. joint wouldn’t grant permission for use in the film. Even a Beastie Boy doesn’t have all the sway. Wow!

We actually did not grant permission because Mr. Yauch did not ask for permission to use the song before placing it in the movie and showing it several times at Tribeca. He too being a musician that has both sampled other people's music and who has had others sample and license his own music knows better.
His music licensing person came to us saying, "If you don't license this song we are ready to use another song." We believe that the correct approach should have been, "We love the song and it fits so perfectly in our movie and we can't think of another song that would make the 3rd quarter come alive". As I said earlier, Mr. Yauch, more then anyone, should know better being a musician, artist, and businessman who licenses his own songs to other movies.
